Abstract

This work approaches the Social Organizations, entities which work in parallel to the State providing similar services to the ones offered in the sphere of government. For this purpose, it is necessary the execution of a management contract with the Public Power. The possibility of waiver of bid is foreseen by the Federal Constitution of 1988. Moreover, there is a Direct Unconstitutionality Action that questions this legal provision. Therefore, it ́s necessary to analyze the im p lications of such waiver in the management of contracts and in the control that is carried out when there are irregularities in the process. The aim of this work is to analyze the DUA in the judgment no 1923 and its repercussion about the establishment of Social Organizations whose m ain objective is the sake of p rofit, thereby contravening what is disposed by the specific law, as well as the control process to combat such practices in Social Health Organizations in Pernambuco.
