Juridicization and Judicialization of Health by the Public Prosecutor’s Office of the State of Minas Gerais Between 2016 and 2020

With the promulgation of the 1988 Constitution, the Public Prosecutor’s Office was consolidated as an institution with the role of ensuring that public authorities and services of public relevance respect the rights guaranteed in the Constitution. This attribution is the origin of the close relationship between the acting of the Public Prosecutor in defending the right to health and the Brazilian National Public Health System. In this performance, two ideal types can be identified: the demanding model and the resolutive model, where the latter prioritizes the extrajudicial attempt of conflict resolution, which is characteristic of the juridicization of health. This paper aimed to contribute to studies of the juridicization of health and furthermore to the understanding of the protection of the right to health exercised by the Public Prosecutor’s Office. To this end it was realized an analysis of the data regarding the procedures registered by the members of the Public Prosecutor’s Office of the State of Minas Gerais in the Unified Registry System between January 1st, 2016 and December 31st, 2020. It was found that the predominant form of action of the Public Prosecutor’s Office of the State of Minas Gerais corresponds to the resolutive model, since only around 10% of the closed procedures had the filing of a lawsuit as an outcome. The analysis also shows the classification by themes and by type of procedure, leading to the interpretation that a more reactive work to the demands brought to the Prosecutor’s Offices prevails at the expense of the appreciation of collective and structuring themes and public policies of the Brazilian National Public Health System.
