Insights about civil liability of psychiatrists for misdiagnosis in involuntary commitment

This article aims at addressing civil liability of psychiatrists for misdiagnosis in involuntary commitment. Even when hospitalization is determined by court order, one cannot disregard the fact that it requires proper justification through medical reporting. The diagnosis that is the basis for court decision must be serious and thorough, so that it can be not only the indicator of mental disorders affecting the patient, but also point at the most appropriate treatment, especially when hospitalization is recommended.
