Abstract

The rise of participatory provisions of citizens in Public Administration is generating excessive bureaucratisation or overproceduralization of state decision making process based on subjective criteria and the casuistry of the interests of the impugned, distorting the function of these instruments to give them importance that do not.  This paper discusses this trend, based on American administrative law, especially through the prism of Vermont Yankee.
