Abstract

This article discusses the boundedness of Public Administration to judicial precedents, giving special emphasis to the role of the Public Advocacy today, in harmony with the new paradigms of Administrative Law, especially with a performance in accordance with the principle of jurisdicity. This action should take place essentially in order to ensure effective and equal protection of fundamental rights formally or materially embodied by the Constitution of 1988. This attachment to judicial precedents, in turn, has its assumption on the principles of equality and legal certainty. This analysis served as the basis for defining a performance of the Public Advocate in line with the eminently primary and towards the enforcement of fundamental rights public interest.
