The Foreign Corrupt Practices Act (FCPA) and a reflection on the brazilian anticorruption microsystem

The FCPA is an important anti-corruption mechanism in US law, which targets the financial source of corruption: bribes paid by large corporations to gain business advantages. The structuring of the diploma is refined and it has points of ambiguity that have not been cleared up, as the law is little challenged in the Courts. Even so, especially due to the culture of settlement that was formed in its orbit, many punishments are applied and huge amounts are collected by the State. A source of inspiration for the Brazilian Anticorruption Law (Law 12.846 / 2013), it has common features and some contrasts with it, so that the FCPA study contributes to highlight sensitive points that demand attention in relation to LAC.
