The imprescriptibility of the right of compensation of intentional improbity against the Public Administration and the return of state’s plenitudo potestatis

This work intends to investigate the imprescritibility of the right to compensation for damages resulting from administrative improbity acts based on the STF decision in RE No. 852.475-SP. Once the final position of the Court adopted the thesis of mitigated imprescritibility, this choice implies a distinction between damage resulting from willful action and culpable negligence as a criterion for the definition of prescriptible situations, which does not exist in the text of article 37, §5, CR/88. Therefore, this work also examines the Judges’ divergent interpretations, including other judgments of the Court, in addition to the different views of constitutionalists and administrativists, among which there are consistent alternative proposals. In conclusion, there are possible negative consequences of the decision, especially the risks offered by a gradual return of the state’splenitudopotestatis in the current Brazilian public law.
