Abstract

This paper demonstrates the limits of action of the municipality, within the scope of its urbanistic constitutional competence. Therefore, we analyze the municipal competence in Urban Law, as well as some aspects of urban property law and its social function. Thereafter, the 49th Binding Summary is observed, through an understanding of the legal basis and the elements of Law and Economics, to note the unconstitutionality of the deterrent to install commercial establishments of the same branch in a certain area. We conclude by the possibility of using propulsion power by the municipality, for the creation of tax and financial incentives, as opposed to direct heterodiscipline.
