Abstract

The understanding of the institutional design that involves the Independent Regulatory Agencies in the American and Brazilian regulatory scenario is of extreme relevance so that the comparisons between the models of both countries can be made and are parallel traces that help in the solution of the legal problems faced in the of regulation in Brazil since the implementation of the entities. In the comparative study of Regulatory Agencies and their respective institutional transplants, the identification of local political and legal peculiarities related to the imported model can help in the incremental change of the normative design of regulation in Brazil, strengthening the institutions and, therefore, promoting the economic, political and social development of the country by ensuring a stable regulatory environment with legal certainty.
