Abstract

The present article analyses, in Portuguese Law, the responsibility of the State with respect to the exercise of the fact of the prince, as well as the protection of the injured contracted part as a result of this act of power. The study, exemplarily, brings the characteristics and definitions of the fact of the prince, which differentiate it from similar figures, as well as its compliance with Portuguese legislation. In a second moment, it presents considerations whether the instability of the administrative contract as a result of the fact of the prince consists of civil State responsibility or indemnity for the sacrifice.
