Abstract

The article aims to include the idea of happiness as the foundation of human development in a social State. Contradicts the possibility of the subsidiarity as a consistent criterion for the welfare state. It analyzes the Brazilian legal system and it makes some considerations regarding the principle of subsidiarity in the European system. The text explains that the social constitutionalism cannot restrict the duties of the State in the exclusive sense to offer dignity. It differentiates the subjective happiness of the objective happiness. It examines the idea of objective happiness in two perspectives: the law and politics. It concludes that only objective happiness is considered criterion to the purposes of the social State, because it implies the maximum guarantee of well being to the people while the dignity applies only to the existential minimum guarantee
