Abstract

This work aims to investigate the concept of right of resistance in Baruch Spinoza in Political Treatise and its commentators. Initially resis-tance is presented in different views, such as in Hobbes and Locke, followed by the hegemonic tradition of political philosophy and then opposed to the concept of civil disobedience. Next, we present Spinoza’s theory and its innovative perspective, which does not differ resisting from obeying, if certain circumstances arise in the political environment. This section starts with a brief contextualization of the resistance and an analysis of its foun-dation in Spinoza, which is the power of the multitude. Finally, the decree No. 8243/14 is introduced to be subjected to the following question: can it be seen as an institutionalization of the resistance in Spinozian terms?
